BACKGROUND

Section 107.165 sets record retention duties for people who submit a declaration of compliance or a means of compliance. A person who submits a declaration must retain, and make available to the Administrator on request, all supporting information used to show that the aircraft meets § 107.120(a) for Category 2 or § 107.130(a) for Category 3. If that person produces the aircraft, the information must be kept for two years after the cessation of production. If the person instead designs or modifies the aircraft, the information must be kept for two years after the declaration was submitted. A person who submits a means of compliance must retain its description for as long as the means of compliance remains accepted.
