BACKGROUND

§ 107.165 sets record retention rules for subpart D. A person who submits a declaration of compliance must retain, and make available to the Administrator on request, all supporting information used to demonstrate that the small unmanned aircraft meets the Category 2 requirements of § 107.120(a) or the Category 3 requirements of § 107.130(a). The retention period depends on the person's role: a producer of the aircraft keeps the information for two years after production of that small UAS ceases, while a person who designs or modifies the aircraft keeps it for two years after submitting the declaration of compliance. Separately, § 107.165(b) requires a person who submits a means of compliance to retain its detailed description and justification for as long as the means of compliance remains accepted.
