BACKGROUND

§ 107.1(b) lists the operations that fall outside 14 CFR part 107. One of them, in paragraph (b)(4), is any operation that a person elects to conduct under part 91 of the chapter with a small unmanned aircraft system that has been issued an airworthiness certificate. In that case the flight is governed by part 91 rather than by part 107. The exclusion depends on two things together: the aircraft holds an airworthiness certificate, and the person chooses to operate under part 91. A small UAS without an airworthiness certificate, or one whose operator does not make that election, remains subject to part 107.
