BACKGROUND

Section 107.41 of 14 CFR part 107 is titled Operation in certain airspace. It prohibits operating a small unmanned aircraft in Class B, Class C, or Class D airspace, or within the lateral boundaries of the surface area of Class E airspace designated for an airport, unless the person has prior authorization from Air Traffic Control (ATC). Class G airspace and Class E airspace that does not begin at the surface for an airport are not covered by this requirement. Section 107.205(h) lists § 107.41 among the regulations subject to waiver.
