BACKGROUND

A declaration of compliance (DoC) is the document an applicant submits to the FAA to declare a small unmanned aircraft compliant with the Category 2 or Category 3 requirements. Under § 107.160(c), before initiating rescission proceedings, the FAA notifies the applicant of any safety issue. If the issue is not resolved, § 107.160(d)(3) lets the FAA issue a notice proposing rescission, and the holder has 30 calendar days from issuance to submit evidence refuting it. If no information is received within those 30 days, the FAA issues a notice rescinding the DoC. In an emergency the Administrator may rescind without this process, and a person subject to a rescission order may petition for reconsideration within 60 days.
