BACKGROUND

§ 107.61 of 14 CFR part 107 lists the eligibility requirements for a remote pilot certificate with a small unmanned aircraft system (UAS) rating. A person must be at least 16 years of age; be able to read, speak, write, and understand the English language; not know or have reason to know of a physical or mental condition that would interfere with the safe operation of a small UAS; and demonstrate aeronautical knowledge in one of two ways. The knowledge requirement is met either by passing an initial aeronautical knowledge test covering the areas in § 107.73 or, for holders of a part 61 pilot certificate (other than a student pilot certificate) who meet the § 61.56 flight review requirements, by completing training under § 107.74. These requirements are subject to §§ 107.57 and 107.59 on alcohol and drug offenses.
