BACKGROUND

Section 107.29(b) prohibits operating a small unmanned aircraft system during periods of civil twilight unless the aircraft has lighted anti-collision lighting visible for at least 3 statute miles with a flash rate sufficient to avoid a collision. Paragraph (c)(2) defines evening civil twilight outside Alaska as the period beginning at official sunset and ending 30 minutes after official sunset. To apply the rule, the remote pilot adds 30 minutes to the official sunset time and checks whether any part of the flight falls within that window. Any flight time after the window ends is night, which carries the additional training requirement in paragraph (a)(1).
