BACKGROUND

Category 3 operations carry the tightest placement limits of the declared categories. Section 107.125(b) forbids operating over open-air assemblies of human beings at all, and § 107.125(c) then allows flight above any human being only under one of two conditions. The first is that the operation is within or over a closed- or restricted-access site and all human beings located within that site are on notice that a small unmanned aircraft may fly over them. The second is that the aircraft does not maintain sustained flight over any human being unless that person is directly participating in the operation or is under a covered structure or inside a stationary vehicle that can provide reasonable protection. A closed site by itself is not enough; the notice is part of the condition.

STUDY TIP

For Category 3, always pair the closed- or restricted-access site with the notice requirement, because questions like to give you the site and ask for the missing piece. Remember that the alternative path is avoiding sustained flight over people rather than avoiding people entirely.
