BACKGROUND

Subpart D of 14 CFR part 107 was added to allow routine operations over human beings and over moving vehicles. Section 107.100 states that the subpart prescribes the eligibility and operating requirements for civil small unmanned aircraft to operate over human beings or over moving vehicles in the United States, in addition to the operations already permitted by § 107.39(a) and (b). Section 107.105 then limits a remote pilot in command to conducting operations over human beings only in accordance with § 107.110 for Category 1, §§ 107.115 and 107.120 for Category 2, §§ 107.125 and 107.130 for Category 3, or § 107.140 for Category 4. The same section carves out the exceptions in §§ 107.39(a) and (b) and 107.145. Each numbered category carries its own aircraft eligibility and operating requirements, so identifying the correct category is the first step in planning any flight over people.

STUDY TIP

Memorize the section map in § 107.105: one section for Category 1, two sections each for Categories 2 and 3, and one section for Category 4. Knowing which category a given aircraft qualifies for tells you which requirements you must meet.
