BACKGROUND

Subpart D of 14 CFR part 107 sets out four categories of operations over human beings. Category 1, in § 107.110, requires a small unmanned aircraft that weighs 0.55 pounds or less on takeoff and throughout the operation and has no exposed rotating parts that would lacerate human skin. § 107.110(b) adds a separate condition for sustained flight over open-air assemblies of human beings: the operation must meet the requirements of either § 89.110 or § 89.115(a). Part 89 is the Remote Identification (RID) regulation listed among the references in the Remote Pilot Airman Certification Standards. The same open-air assembly condition appears in § 107.115(b) for Category 2 and in § 107.140(a)(2) for Category 4.
