BACKGROUND

Subpart D of 14 CFR part 107 governs small unmanned aircraft eligible for Category 2 and Category 3 operations over human beings. A means of compliance (MoC) is the method used to show that a small unmanned aircraft meets the requirements of § 107.120(a) for Category 2 or § 107.130(a) for Category 3, while a declaration of compliance (DoC) is the record submitted to the FAA certifying that a particular aircraft conforms to those requirements. Section 107.165 sets separate record-retention rules for each. Under § 107.165(b), a person who submits a means of compliance must retain the detailed description of it and the justification showing how it meets those requirements, and make them available to the Administrator on request, for as long as the means of compliance remains accepted. By contrast, § 107.165(a)(2) gives declaration-of-compliance submitters fixed two-year periods measured from cessation of production or from the date the declaration was submitted.

Read § 107.165 as two separate rules and keep straight which record each one covers: the means of compliance is tied to how long acceptance lasts, while the declaration of compliance is tied to fixed two-year periods. Memorize the trigger for each two-year clock as well, because producing an aircraft and designing or modifying one start the clock at different events.
