BACKGROUND

Section 107.69 lists conduct an applicant for a knowledge test may not engage in, including copying or intentionally removing a test, giving or receiving any part or copy of a test, giving or receiving assistance while the test is being given, taking a test on behalf of another person, being represented by another person, and using unauthorized materials or aids. It also prohibits intentionally causing, assisting, or participating in any of those acts. When the Administrator finds a person committed one of those acts, § 107.69(b) prohibits that person, for 1 year after the date of committing the act, from applying for any certificate, rating, or authorization issued under this chapter and from applying for and taking any test under this chapter. Separately, § 107.69(c) allows any certificate or rating the person already holds to be suspended or revoked. This 1-year bar is distinct from § 107.71, which says an applicant who fails a knowledge test may not reapply for the test for 14 calendar days.
