QUESTIONUnder 14 CFR part 107, what must a request for a certificate of waiver contain?

  1. AA copy of the remote pilot certificate and proof of aircraft registration only
  2. BA written report of any prior deviations from part 107 rules
  3. CA complete description of the proposed operation and a safety justification
Show the answer and explanation

Correct answer: C. A complete description of the proposed operation and a safety justification

  • A — incorrect § 107.200(b) does not describe the request in terms of certificate or registration documents; it requires a description of the operation and a safety justification.
  • B — incorrect A written report of a deviation is what § 107.21(b) requires after an in-flight emergency, on request of the Administrator; it is not the content of a waiver request.
  • C — correct § 107.200(b) requires a complete description of the proposed operation and justification that establishes the operation can safely be conducted under the terms of a certificate of waiver.

BACKGROUND

Subpart E of 14 CFR part 107 sets the waiver policy for small unmanned aircraft system (sUAS) operations. Under § 107.200(a), the Administrator may issue a certificate of waiver authorizing a deviation from any regulation listed in § 107.205 if the proposed operation can be conducted safely under the terms of the waiver. The request itself, per § 107.200(b), must contain a complete description of the proposed operation and a justification establishing that it can be conducted safely. The Administrator may also prescribe additional limitations under § 107.200(c).

STUDY TIP

Remember the two-part content of a waiver request: describe the operation completely and justify its safety. Do not confuse it with the post-emergency written report in § 107.21.

KEY POINTS

  • A waiver request needs a complete description of the proposed operation.
  • It must also include justification that the operation can be conducted safely.
  • The Administrator may add further limitations when issuing the waiver.
