BACKGROUND

Category 4 is the category for small unmanned aircraft that have gone through the FAA's airworthiness certification process. Under § 107.140(b), the aircraft must have an airworthiness certificate issued under part 21, be operated in accordance with the operating limitations in the approved Flight Manual or as otherwise specified by the Administrator, and those limitations must not prohibit operations over human beings. The aircraft must also have maintenance, preventive maintenance, alterations and inspections performed in accordance with § 107.140(c). Like Categories 1 and 2, Category 4 prohibits sustained flight over open-air assemblies unless the operation meets § 89.110 or § 89.115(a).
