BACKGROUND

Section 107.145 governs operation over a human being located inside a moving vehicle. The operation must first be conducted under one of the four categories (§ 107.110, § 107.115, § 107.125 or § 107.140). For Category 1, 2 or 3 operations, the aircraft must throughout the operation either remain within or over a closed- or restricted-access site where everyone in the moving vehicles is on notice that an aircraft may fly over them, or must not maintain sustained flight over moving vehicles. For Category 4, the aircraft must have a part 21 airworthiness certificate and Flight Manual limitations that do not prohibit operations over people in moving vehicles. A public highway is not a closed-access site, so the no-sustained-flight condition is the only available option.
