BACKGROUND

Under § 107.120(b)(2) for Category 2 and § 107.130(b)(2) for Category 3, the applicant for a declaration of compliance must have remote pilot operating instructions that apply to the operation of the small unmanned aircraft system. The applicant must make these instructions available upon sale or transfer of the aircraft, or when the aircraft is used by someone other than the applicant who submitted the declaration. The instructions must at a minimum address a system description, modifications that do not change category eligibility, and how to verify and change the mode or configuration if it is variable. This ensures every remote pilot flying the aircraft over people has the information needed to keep it within its declared category.
